Attorney Benjamin Clifton Jr. of Raleigh, NC; slacker, serial offender

 

The state of North Carolina presented Benjamin F. Clifton Jr.  with a law license in 1970 after he graduated from the University of North Carolina Law School.

 

The Grievance Committee of the North Carolina State Bar found Benny guilty of the following misconduct.

 

Benny’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to act with due diligence (slacker)
  • Failed to appear at hearing on client’s behalf
  • Failure to appear at hearing caused court to dismiss client’s case
  • Failed to take any steps to remedy neglect causing dismissal of client’s case
  • Engaged in conduct prejudicial to the administration of justice
  • Made false statement of fact to ethics investigators (Up yours, said Benny!)

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Benny by gifting him with a complimentary reprimand.

 

Benny’s 2nd bite at the Attorney Misfit Apple Tree

 

  • Failed to appear in court on client’s behalf as promised
  • Failed to deposit client advance fee in trust account as required
  • Cashed client’s advance fee check at the Longbranch Saloon
  • Failed to return repeated client phone calls
  • Failed to act with due diligence (slacker)

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Benny by gifting him with a second complimentary reprimand.

Benny’s 3rd bite at the Attorney Misfit Apple Tree

 

  • Assisted non-attorney in the illegal practice of law
  • Allowed third party to direct decision making
  • Failed to act with due diligence (slacker)
  • Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation

As a consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Benny by gifting him with a complimentary censure.

 

As we speak (ca. July 2015) Benny practices with Clifton & Singer LLP at 2840 Plaza Place in Raleigh, North Carolina.
