Judge Clyde Andress of Arizona; ethical gnome, certified Dumbo

 

Unfortunately, Judge Clyde Andress has been sitting on the Municipal Court bench in Lake Havasu, Arizona since 1998.
 
As you’ll see below, Judge Andress is a repeat offender having taken 4 bites at the Judicial Misconduct Tree from 2002 through 2010.
 
1st bite at the Judicial Misfit Apple Tree (ca. 2003)
 
In his 1st bite at the Judicial Misfit Apple Tree was found guilty of engaging in ex parte communications. This means that he unlawfully held discussions with one attorney in the case without the other having any knowledge of it.
 
The Judicial Commission ruled that Clyde’s purpose in so acting was to obtain factual information from the attorney.
 
For this misconduct, the Arizona Supreme Court gifted Clyde with a complimentary private warning.
 
2nd bite at the Judicial Misfit Apple Tree (ca. 2005)
 
In 2005 the Judicial Commission found Clyde guilty of losing his temper and threatening to jail someone who was merely attempting to obtain copies of court records.
 
For this misconduct, the Arizona Supreme Court gifted Clyde with a complimentary private advisory.
 
3rd bite at the Judicial Misfit Apple Tree (ca. 2007)
 
In this instance, Clyde was found guilty of violating court rules that allow litigants to be heard (aka, due process). Clyde had the chutzpah to threaten an attorney with contempt (imprisonment) if he continued to try and place an objection on the record on behalf of his client.
 
For this misconduct, the Arizona Supreme Court gifted Clyde with a complimentary reprimand.
 
4th bite at the Judicial Misfit Apple Tree (ca. 2010)
 
Anyone with an I.Q. equal to or less than the legal speed limit in a school zone would have reasonably concluded that Ol’ Clyde would again cheerfully engage in misconduct.
 
In this case, Clyde was found guilty of again engaging in ex parte communications in order to obtain facts about a pending matter.
 
In fact, Clyde personally embroiled himself in a matter involving a girl’s softball team and attempts by a set of parents to have one girl reinstated and one parent prohibited from appearing at games.
 
Clyde’s Il Duce Wannabee conduct included illegal ex parte communications with (a) league coaches, (b) the city manager, (c) other city officials, and (d) his so-called “off the record” conversations with one attorney involved in the case.
 
For his 4th bite at the Judicial Misfit Apple Tree, the enablers/apologists sitting on the Arizona Judicial Commission gifted Clyde with a complimentary censure.
 
As we speak (ca. Jan 2011) Clyde remains sitting on the bench in Lake Havasu. What a joke and what a loser!
