Attorney Eugene Simmons of Marlinton, WV; serial offender

 

The state of West Virginia presented Eugene Maynard Simmons with a law license in 1961.

 

The Lawyer Disciplinary Board found Gene guilty of the following misconduct

 

Gene’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to communicate with client
  • Failed to act with due diligence (slacker)
  • Failed to promptly return client file
  • Failed to promptly notify clients his license suspended

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the West Virginia Supreme Court punished Gene by gifting him with a complimentary 1-month suspension of his law license.

 

Gene’s 2nd bite at the Attorney Misfit Apple Tree

  • Failed to prepare final orders in 42 criminal cases before leaving the Office of Prosecuting Attorney of Pocahontas County
  • Failed to timely return client file after being terminated
  • Failed to submit required documents in several cases

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the West Virginia Supreme Court punished Gene by gifting him with a complimentary admonishment.

 

Gene’s 3rd bite at the Attorney Misfit Apple Tree

  • Failed to notify his client that his law license as suspended
  • Failed to advise client of status of legal matter
  • Failed to return numerous client phone calls
  • Failed to return client file to new attorney as client requested
  • Failed to refund unearned fees (cheater)
  • Failed to timely respond to ethics complaint (Up yours, said Gene!)
  • Failed to act with due diligence (slacker)
  • Failed to take reasonable steps to protect client interests after being fired
  • Failed to comply with court order regarding discovery
  • Failed to advise client that the court had dismissed her case
  • Violated a duty he owed to his client

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the West Virginia Supreme Court punished Gene by gifting him with a complimentary 6-month suspension of his law license.

 

As we speak (ca. March 2015), Gene practices at 900 Tenth Avenue in Marlinton, West Virginia.
