Attorney David Stanifer of Tazewell, TN; lying loser

The state of Tennessee provided David Hall Stanifer with a law license in 1982 after he graduated from the YMCA Law School.

The Tennessee Board of Professional Responsibility found Dave guilty of the following misconduct.

In one matter, Dave represented the estate of a Tennessee decedent who had owned land in Virginia. Some of the twelve heirs to the estate asked Dave to handle the sale of the Virginia land. They stated that they did not want to get an administrator in Virginia. Dave advised them that they give him power of attorney, and he circulated a sample power of attorney form to the heirs.

Dave received powers of attorney purportedly, signed by all of the heirs. By his own admission, Dave, as a notary public, signed the notary statement at the end of some of the powers of attorney, that the statements were "sworn to and subscribed before him,” which was patently false because not all of the heirs appeared before him.

As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Tennessee Supreme Court punished Dave by gifting him with a complimentary censure.

As we speak (ca. March 2016) Dave practices at 1735 Main Street in Tazewell, Tennessee.
