The state of Delaware presented R. David Fatava with a law license in 1988.

The Delaware Board of Professional Responsibility found Fatava guilty of the following misconduct all of which took place while he was employed by the Delaware Department of Justice in Kent County as a Deputy Attorney General (Prosecutor).

• Knowingly made a false statement of fact to a tribunal
• Engaged in a pattern of unprofessional conduct during a trial
• Improperly stated a personal opinion as to credibility of witness and/or the guilty of an accused
• Engaged in conduct intended to disrupt a tribunal
• Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
• Mocked defendant during cross-examination at trial
• Engaged in conduct prejudicial to the administration of justice
• Improperly made disparaging remarks about defendant during trial
• During trial made numerous demeaning comments specifically aimed at a defendant that was representing himself

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Disciplinary Board punished Donnie by gifting him with a complimentary 6-month suspension of his law license.

As we speak (ca. August 2015), Donnie will have his license reinstated in February 2016, which should allow him to continue in his zeal to act like a certified clown while prosecuting defendants in Kent County.
