Attorney Charles Borth of Spencer, IA; ethical gremlin

The state of Iowa presented Charles K. Borth with a law license in 1995 after he graduated from Drake University Law School.

The Iowa Supreme Court Attorney Disciplinary Board found Charlie guilty of the following misconduct. At the time of his misconduct, Charlie was employed as an Assistant Clay County Attorney.

  • Engaged in conflict of interest by representing father in criminal case while also employed as Assistant Clay County Prosecutor
  • Amended traffic citations to cowl-lamp violations that he knew were not supported by probable cause
  • Negotiated plea bargains that required defendants to contribute to various funds, including funds maintained by governmental subdivisions, contrary to Iowa law

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Iowa Supreme Court punished Charlie by gifting him with a complimentary reprimand.

As we speak (ca. June 2015), Charlie practices at 215 West Fourth Street in Spencer, Iowa.
