Attorney Joe Westmeyer, Jr. of Toledo; cheating loser

The state of Ohio presented Joseph W. Westmeyer Jr. with a law license in 1997 after he graduated from Ohio Statue University Law School.

Disciplinary Counsel of the Ohio Supreme Court found Joey guilty of the following misconduct.

In one matter, Joey represented a client who filed a wrongful death action against Columbia Gas when her husband died from an explosion from a leaking gas line.

Westmeyer contingent fee agreement called for him to be paid 33% of any settlement and 40% if the case went to trial.

Prior to the trial date, defense counsel made an offer of $1 million to settle the case. Despite disciplinary rules that required Westmeyer to advise his client of the offer, he chose to remain silent.

After a jury was selected for the trial, Westmeyer asked defense counsel if the $1 million offer was still available. When defense counsel said yes, Westmeyer then advised his client to accept the offer, which she did.

Westmeyer’s concealment of the original settlement offer and subsequent offer after trial commenced allowed him to illegally pocket an additional 7% of the $1 million in fees or $70,000.

As one would suspect, this wasn’t Joey’s First bite at the Attorney Misfit Apple Tree. He also received another complimentary suspension of his law license for engaging in a variety of misconduct.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Ohio Supreme Court punished Joey the Cheater by gifting him with a complimentary reprimand 1-year suspension of his law license.
